Welcome to NameHub. These Terms of Service ("Terms") govern your access to and use of the NameHub website, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Eligibility

To use the Service, you must:

Be at least 13 years of age (or the minimum age of digital consent in your jurisdiction)
Have the legal capacity to enter into a binding agreement
Not be barred from using the Service under applicable law

If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Registration

2.1 Creating an Account

To access certain features of the Service, you must create an account. When registering, you agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information to keep it accurate
Maintain the security of your password and accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account

2.2 Account Restrictions

You may not create more than one account per person
You may not use another person's account without their permission
You may not create an account using false or misleading information
You may not create accounts through automated means (bots, scripts, etc.)

2.3 Account Suspension and Termination

We reserve the right to suspend or terminate your account at any time, without prior notice, for any reason, including but not limited to:

Violation of these Terms
Engaging in fraudulent or illegal activity
Behavior that is harmful to other users or the Service
Extended periods of inactivity (12 months or more)

3. Use of the Service

3.1 Permitted Use

The Service is provided for personal, non-commercial use. You may:

Browse and search the name database
Create an account and manage your profile
Save names to your favorites list
Create and share name lists with descriptions and notes
Leave reviews and comments on names and name lists
Build and manage a personal family tree
Use the contact form to communicate with our team
Share content from the Service via the provided sharing features

3.2 Prohibited Conduct

You agree not to engage in any of the following activities:

Harmful content: Post, upload, or distribute content that is offensive, abusive, threatening, discriminatory, defamatory, obscene, or otherwise objectionable
Spam and manipulation: Submit fake reviews, misleading ratings, repetitive comments, or content designed to manipulate search rankings or user perceptions
Impersonation: Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
Scraping and automation: Use any robot, spider, scraper, or other automated means to access the Service or extract data without our written permission
Interference: Attempt to disrupt, overload, or interfere with the proper functioning of the Service, including through denial-of-service attacks or the introduction of malware
Circumvention: Attempt to bypass any security measures, rate limiting, or access controls implemented on the Service
Commercial exploitation: Use the Service or its content for commercial purposes without our written authorization, including republishing name data in bulk
Illegal activity: Use the Service for any purpose that is unlawful or prohibited by these Terms

4. User-Generated Content

4.1 Your Content

The Service allows you to submit, post, and share content, including but not limited to reviews, comments, name lists, descriptions, and family tree information (collectively, "User Content"). You retain ownership of your User Content, subject to the license granted below.

4.2 License Grant

By submitting User Content to the Service, you grant NameHub a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, display, distribute, and create derivative works of your User Content in connection with the operation and promotion of the Service. This license continues even if you stop using the Service, but we will honor deletion requests as described in our Privacy Policy.

4.3 Content Standards

You represent and warrant that your User Content:

Is your original work or you have the necessary rights to submit it
Does not infringe the intellectual property rights or other rights of any third party
Does not contain any viruses, malware, or other harmful code
Does not violate any applicable law or regulation
Does not contain personal information about others without their consent
Is truthful and not misleading

4.4 Content Moderation

We reserve the right, but are not obligated, to:

Review, screen, and moderate User Content before or after it appears on the Service
Remove or disable access to any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable
Require admin approval for certain types of content (e.g., name lists) before publication
Edit User Content for formatting purposes without altering the substance

We are not responsible for any User Content submitted by users of the Service. You understand that by using the Service, you may be exposed to User Content that you may find offensive or objectionable.

5. Name Data and Information

5.1 Accuracy

The name data provided on the Service (including origins, meanings, historical information, and related names) is compiled from various public and scholarly sources for educational and informational purposes. While we strive for accuracy, we make no representations or warranties regarding the completeness, accuracy, reliability, or currency of this information.

5.2 Not Professional Advice

The information provided on the Service does not constitute professional, legal, medical, or other advice. You should not rely solely on the information provided on the Service for important decisions. Always consult appropriate professionals when needed.

5.3 Data Sources

Name data is compiled, rewritten, and translated to ensure originality. The presentation and organization of this data is the intellectual property of NameHub.

6. Intellectual Property

6.1 NameHub's Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of NameHub. This includes, but is not limited to:

The NameHub name, logo, and branding
Website design, layout, and user interface
Compiled and curated name database content
Translated and rewritten name descriptions
Software, code, and technical infrastructure

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

6.3 Restrictions

You may not:

Copy, modify, or distribute the Service or any content without authorization
Reverse engineer, decompile, or disassemble any part of the Service
Remove any copyright, trademark, or other proprietary notices
Create a competing service using data obtained from NameHub

7. Reviews, Ratings, and Comments

Reviews and ratings should reflect your genuine opinion and experience
You may submit only one review per name and one comment per name list
You may not submit reviews or comments for names or lists you have not genuinely engaged with
Reviews and comments must comply with the content standards outlined in Section 4.3
We reserve the right to remove reviews or comments that violate these Terms
The author of a name list cannot rate or comment on their own list

8. Name Lists

Name lists submitted by users require admin approval before being published
We reserve the right to reject name lists that do not meet our content standards
You may edit or delete your own name lists at any time
Published name lists are visible to all visitors of the Service
Name lists should contain meaningful, curated selections rather than random or bulk entries

9. Third-Party Links and Services

The Service may contain links to third-party websites or services that are not owned or controlled by NameHub, including social media sharing features (Facebook, X/Twitter, Pinterest). We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. Your use of third-party services is at your own risk and subject to the terms and policies of those services.

10. Disclaimers

10.1 "As Is" Basis

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 No Guarantee

We do not guarantee that:

The Service will be available at all times or without interruption
The information provided will be accurate, complete, or current
The Service will be free from errors, viruses, or other harmful components
Any defects in the Service will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NAMEHUB AND ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your access to or use of (or inability to access or use) the Service
Any conduct or content of any third party on the Service
Any User Content obtained from the Service
Unauthorized access, use, or alteration of your transmissions or content

12. Indemnification

You agree to defend, indemnify, and hold harmless NameHub and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

Your use of and access to the Service
Your violation of these Terms
Your violation of any third-party right, including intellectual property or privacy rights
Any User Content you submit to the Service

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which NameHub operates, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved through good faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of the applicable jurisdiction.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Waiver

The failure of NameHub to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by NameHub.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NameHub regarding the use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

Update the "Last Updated" date at the top of this page
Post the revised Terms on this page
Notify registered users of material changes via email (where practicable)

Your continued use of the Service after any modifications to the Terms constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Service and delete your account.
